If the property was in a living trust, the successor trustee can sell it without court involvement. If not, it goes through probate in LA County Superior Court, where the personal representative sells it either with full authority under the Independent Administration of Estates Act (no court confirmation) or with limited authority (court confirmation and overbid). Heirs usually receive a stepped-up tax basis to the value at death, which minimizes capital gains. Beyond Estates coordinates with probate attorneys, handles cleanouts through Beyond Renovations, and sells as-is or renovated. Call (661) 441-3706.
Trust vs probate
- Living trust: the successor trustee signs the listing and sale. Weeks, not months. Need: trust certification, death certificate, trustee ID.
- Probate with full IAEA authority: the administrator or executor lists and sells with a Notice of Proposed Action to heirs; no court hearing on the sale.
- Probate with limited authority: the sale must be confirmed in court, where others can overbid. Buyers need to be educated; we are.
- Small estates: California allows simplified transfer for estates under the statutory threshold.
Taxes
Heirs generally get a stepped-up basis to fair market value at the date of death, so selling soon after usually means little or no capital gains tax. Prop 19 changed parent-child property tax reassessment; unless an heir moves in as a primary residence, the property is reassessed. Talk to a CPA and an estate attorney; we can refer both.
Selling as-is vs fixing up
Many inherited AV homes are dated and full of belongings. Options: sell as-is to our investor list or to Charly directly for a fast cash close; or let Beyond Renovations clean out, paint and floor it at priority pricing (often paid at closing) and sell retail with Zillow Showcase for a higher net. We show you both numbers.
Out-of-state heirs
Everything can be done remotely: video walkthroughs, electronic signatures, mobile notaries, and we manage the cleanout, utilities and lawn until closing.

Not if the home was held in a living trust or passes by other non-probate means. Otherwise, yes, through LA County Superior Court; Beyond Estates works with probate attorneys and can refer one.

Yes. Beyond Estates can bring a cash offer from its investor list or from Charly Daoud directly, or prepare the home for a retail sale, whichever nets you more.
